Divorce is the formal process by which parties end a marriage. It is often helpful to obtain legal advice and assistance in respect of Divorce, particularly if there are complications. However, it is proceedings which parties can usually handle on their own, without legal representation.
Divorce can be obtained a period of separation of twelve months (it is important to note that it is only for the Divorce that you have to wait for twelve months. There is no waiting period to issue or resolve parenting or property issues). Proceedings can be brought jointly, and if so, where there are children, it may avoid the need for anyone to attend at the court.
It is also important to note that any proceedings for property settlement or maintenance must be commenced within twelve months of a Divorce becoming final or a party can lose the right to make such application.
